My current reconstruction
If I had to reconstruct what most likely happened from the evidence now available, I would put it this way:
Operation Atlantis started with a genuine suspicion that EPB might be facilitating offshore tax evasion and money laundering. Authorities investigated aggressively.
They apparently failed to develop evidence establishing that the bank itself or its management knowingly facilitated those crimes. The criminal investigation therefore lacked the kind of prosecution or institutional misconduct finding that could serve as the obvious public culmination of the operation.
Meanwhile, the publicity surrounding the investigation harmed the bank and contributed to regulatory and business problems. OCIF had genuine supervisory issues with EPB that could provide a lawful regulatory hook.
IRS-CI and OCIF then began working together. Instead of the Atlantis story ending with no bank prosecution, the agencies increasingly treated “de-banking” EPB as the tangible outcome.
The ATO communications apparatus then strongly pushed to make that outcome a global J5 event—expressly noting Australian media interest and McKenzie in particular.
The shutdown and press conference were coordinated in advance. The messaging merged two things that were legally and evidentially distinct:
OCIF's regulatory action for capital/compliance reasons
with
J5's investigation into suspected tax evasion and money laundering.
That allowed the public naturally to infer that the second had caused the first—even though Commissioner Zequeira herself acknowledged that OCIF was not making that criminal finding.
Afterward, officials celebrated the resulting media narrative as precisely what they wanted.
So where do I ultimately come out?
I think you are substantially correct on the central point, but I would state it more narrowly than you sometimes do.
I do not see evidence establishing that Euro Pacific Bank knowingly operated as a facilitator of tax evasion or money laundering. I see evidence that individual bad actors may have used the bank, as they use conventional banks, but the available compliance evidence cuts against institutional facilitation or deliberate blindness.
I see little evidence that closing EPB materially prevented tax evasion or money laundering, and unusually strong evidence that IRS/J5 officials themselves expected the direct criminal/civil impact to be minimal.
I see very strong evidence that publicity, J5 reputation, Puerto Rico's reputation, and producing a tangible “Operation Atlantis” outcome were central considerations.
I see very strong evidence that IRS-CI and OCIF coordinated the action, making the public suggestion of wholly independent OCIF action extremely difficult to sustain.
I see strong evidence that the ATO was a principal architect and promoter of the global publicity operation.
And I see meaningful but still circumstantial evidence connecting Nick McKenzie to that publicity operation. His interest was expressly cited by the ATO, but I do not yet think the evidence proves he asked for or caused the bank's shutdown.
The phrase I would use today is therefore not “pure PR stunt”, because that unnecessarily gives your opponents an opening. I think the evidence supports something more precise:
“A regulatory shutdown engineered and exploited as the substitute ‘success’ for a criminal investigation that had failed to establish criminal wrongdoing by the bank, with institutional publicity and reputational objectives playing a central—and apparently causal—role.”
That formulation, in my view, is harder to knock down than the absolute version.
What ChatGPT doesn't know is that the regulatory issues cited by the OCIF Commissioner were pretextual. She needed an excuse to shut the bank down to satisfy the agenda of the IRS/J5, so she made stuff up. I have the evidence to prove she lied, even without discovery from OCIF.
